Terms of Service for PunchPoint

These Terms of Service ("Terms") govern your access to and use of the PunchPoint mobile software application for Android, as well as the website at https://punchpoint.pinpointcontact.com (collectively, the "Service"), provided by PinPoint Contact ("we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, accessing, or using PunchPoint, you agree to be bound by these Terms. If you are entering into these Terms on behalf of a construction company or general contractor entity, you represent that you have authority to bind that entity.

2. License and Acceptable Use

We grant you a non-exclusive, non-transferable, revocable license to use the PunchPoint Android app on compatible mobile devices for your internal business operations. You agree not to:

Reverse engineer, decompile, or attempt to derive the source code of the application.
Use the Service to transmit defamatory, infringing, or unlawful media.
Bypass or attempt to defeat any security controls or device verification safeguards.

3. Jobsite Content & Subcontractor Communications

You retain full ownership of all punch items, project photos, and field notes recorded in PunchPoint. You are solely responsible for ensuring you have adequate permissions to capture photos on your designated job sites.

4. Subscription Billing & Account Tiers

Access to crew sync, company roster management, and PinPoint Contact platform integration requires an active subscription under your PinPoint Contact account. Terms and refund policies are governed by your master agreement with PinPoint Contact.

5. Disclaimer of Warranties

PunchPoint is provided on an "AS IS" and "AS AVAILABLE" basis. While our offline engine and single-shot GPS systems are engineered for high jobsite reliability, we do not warrant that operation will be uninterrupted or error-free. Contractors remain solely responsible for validating building code compliance, architectural fidelity, and trade subcontractor sign-offs.

6. Limitation of Liability

In no event shall PinPoint Contact be liable for indirect, incidental, special, consequential, or punitive damages, including loss of jobsite profits, construction delay claims, or data loss arising out of the use or inability to use PunchPoint.

7. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law principles.
